Applicable jurisdiction: New South Wales, Australia

1. General Legal Notice

By booking, collecting or using a trailer or other equipment supplied by Trailer 4 Hire, the Hirer acknowledges that the hire is subject to the applicable Dry Hire Agreement, Terms and Conditions, and relevant Australian laws.

All customers must familiarise themselves with the safe operation of the hired equipment and comply with the applicable towing, loading, licensing and road safety requirements.

2. Responsibility for Safe Towing

The Hirer is responsible for ensuring that:

  • The towing vehicle is legally permitted and suitably rated to tow the trailer.

  • The towbar, coupling, safety chains, braking system and electrical connections are compatible and properly secured.

  • The driver holds a current and appropriate driver's licence.

  • The trailer and towing vehicle do not exceed their permitted weight limits.

  • All loads are correctly distributed and securely restrained.

  • The trailer is operated safely and in accordance with applicable laws.

The Hirer must not operate the trailer if an unsafe condition is identified and must immediately notify Trailer 4 Hire.

3. Inspection Before Use

Before departing, the Hirer must conduct a reasonable visual inspection of the trailer, including the tyres, wheels, coupling, safety chains, lights, brakes, ramps, gates, latches and other relevant components.

Any visible damage, missing equipment or suspected safety defect must be reported before departure.

Trailer 4 Hire remains responsible for its legal obligations concerning the roadworthiness, maintenance and safety of its equipment.

4. Damage, Loss and Theft

The Hirer may be held financially responsible for damage, loss or theft arising from misuse, negligence, overloading, improper operation, failure to secure the trailer or breach of the Dry Hire Agreement.

Such responsibility may include reasonable and substantiated repair, replacement, towing and recovery costs, where legally recoverable.

The Hirer will not be charged for fair wear and tear or for loss caused by Trailer 4 Hire's own breach of legal obligations.

5. Optional Trailer Damage Insurance

Trailer 4 Hire offers optional trailer damage protection for an additional fee, subject to confirmation of the applicable insurance or protection arrangement.

The fee varies according to the type of trailer and the duration of hire.

A $750 excess applies to eligible claims, subject to the relevant policy or protection terms, conditions, exclusions and limits.

Customers who decline this option remain responsible for damage or loss to the extent specified in the Dry Hire Agreement and permitted by law.

The availability and scope of cover must be confirmed before purchase.

6. Accidents, Breakdowns and Incidents

In the event of an accident, breakdown, theft or mechanical problem, the Hirer must:

  • Stop using the trailer where continued use would be unsafe.

  • Take reasonable precautions to prevent further damage or injury.

  • Contact Trailer 4 Hire as soon as reasonably possible.

  • Notify emergency services or police where required.

  • Obtain approval before arranging non-emergency repairs.

Responsibility for roadside assistance and recovery costs will depend on the cause of the incident, the hire agreement and applicable law.

7. Hire Period and Additional Charges

The Hirer must return the trailer by the agreed date and time.

Extensions must be approved by Trailer 4 Hire before the scheduled return time.

Early returns do not automatically entitle the Hirer to a refund for unused hire time where the agreed service has been supplied, subject to statutory rights.

Unauthorised late returns, missing accessories, excessive cleaning requirements or damage caused by the Hirer may result in reasonable additional charges in accordance with the disclosed Terms and Conditions.

8. Booking Cancellations

For voluntary cancellations received more than 36 hours before the scheduled hire commencement, Trailer 4 Hire offers a booking credit less a $15 administration fee.

The credit has no expiry date.

Booking amendments may be made without an amendment fee, subject to availability and any difference in hire price.

Cancellation requests must be submitted to bookings@trailer4hire.com.au.

These conditions do not exclude any refund, cancellation or other rights available under Australian Consumer Law.

9. Liability and Australian Consumer Law

Trailer 4 Hire does not accept liability for loss or damage caused solely by the Hirer's unlawful, negligent or improper use of hired equipment.

However, nothing in this notice or the Dry Hire Agreement excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under Australian Consumer Law.

Trailer 4 Hire remains responsible for its own negligence, defective equipment, failure to comply with statutory obligations and other liabilities imposed by law.

10. Customer Acknowledgement

By accepting the Dry Hire Agreement, the Hirer acknowledges that they have been provided with an opportunity to read and understand the applicable Terms and Conditions, including their responsibilities concerning towing, loading, trailer care, safe operation and return.

Acceptance of these Terms does not remove or limit any statutory consumer rights.
